Is dissatisfaction with the performance of a maid in the UAE grounds for dismissal?
Employers in the UAE, if they are not satisfied with the performance of their domestic worker, can terminate the cooperation before the end of the contract under specific conditions; however, this decision must comply with the law and may entail obligations such as paying claims and the cost of the return ticket.
According to Federal Law No. 9 of 2022 regarding domestic workers, if either party violates their legal obligations, the other party can unilaterally terminate the contract while adhering to the conditions and legal procedures.
The employer is obligated to pay the agreed-upon wages, provide suitable accommodation and medical care for the worker, and treat them with respect. In return, the maid must perform the agreed-upon duties diligently, follow the employer's lawful instructions, and protect their property.
Therefore, if the maid fails to perform her duties correctly or violates her legal obligations, the employer may consider terminating the contract based on the circumstances of the case.
However, the costs of ending the cooperation due to termination depend on the circumstances. If the employer terminates the contract for reasons not related to the worker, they must pay for her return ticket to her home country and settle all unpaid claims.
In case of a dispute between the employer and the maid that cannot be resolved through agreement, the matter can be referred to the Ministry of Human Resources and Emiratisation (MOHRE) through legal procedures.
Before terminating the contract, it is advisable for the employer to document issues related to the worker's performance, review the contract terms, pay wages and other claims, and carry out the legal procedures for canceling the work and residency permit.
