Question: I work at a mainland Dubai company. One month before my approved leave starts, I have been assigned a project with a three-month deadline. My manager says I must work during my leave if necessary and is unwilling to assign the project to someone else. Does the employer have the right to make such a request? If I do not deliver the project on time, can I be fired?

Answer: According to Article 29 of the UAE Labor Law, the dates of annual leave are determined by agreement between the employer and the employee based on work needs. The employer is required to inform the employee of the leave dates at least one month in advance.

Based on this law, the employer cannot unilaterally require you to work during your leave. However, if both parties agree, working during this period is possible.

Additionally, the employer cannot dismiss you solely due to a conflict between the project deadline and the approved leave. Such a dismissal could be considered arbitrary under Article 47 of the Labor Law, and the employer would be required to pay compensation up to three months' salary.

If you agree to work during your leave, the employer must compensate these days with compensatory leave or additional pay.

In the case of pressure or unfair actions by the employer, you can file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE).
